Balanced Kids Health – Terms of Service & Membership Agreement

Effective Date: July 16, 2025 (or date of purchase, whichever is later)

Welcome to Balanced Kids Health, LLC (“Balanced Kids,” “we,” “us,” or “our”). By accessing our website, purchasing a membership or package, or using any services provided by Balanced Kids, you (“you,” “your,” “Member,” or “family”) agree to be bound by the following Terms of Service and Membership Agreement (“Agreement”). Please read carefully.

1. Practice Overview & Care Model

Balanced Kids Health is a concierge-style pediatric medical practice offering in-home, group, and virtual care with an emphasis on personalized, relationship-based services for children and families.

You acknowledge and agree that:

Balanced Kids does not provide emergency care. In an emergency, call 911 or go to the nearest emergency department.
Balanced Kids is not health insurance, and this Agreement does not constitute an insurance contract.
Medical outcomes cannot be guaranteed; care is provided using clinical judgment and evidence-informed practices.

2. Eligibility

By using our services, you confirm that you:

Are at least 18 years old
Are the parent or legal guardian authorized to consent for the child(ren) receiving care
Reside in a location where Balanced Kids is licensed and able to provide services

3. Scope of Services

Balanced Kids provides non-emergency pediatric care within our licensed scope, including but not limited to:

In-home and group pediatric physicals
In-home pediatric well-child checks
Virtual sick visits and medical consultations
Health education for parents and caregivers
Integrative and plant medicine education consultations
Ongoing relationship-based pediatric support

Care Pathways

Balanced Kids offers care through three pathways:

À La Carte Services

One-time, pay-per-visit in-home or virtual pediatric care
Same-day availability may be offered when possible but is not guaranteed

Sick Kids Membership

Designed for families with frequent illness needs
Includes prioritized sick care when available and ongoing communication during illness episodes
Compatible with maintaining a separate primary care provider

Balanced Kids Membership

Our most inclusive plan
Comprehensive relationship-based care including well-child, sick, and ongoing support
Enhanced access, continuity, and proactive care planning

You acknowledge that you have reviewed and understand what services are included and excluded in your selected plan as outlined in the Balanced Kids Information Packet.

4. Enrollment, Activation & Communication

Care does not begin with payment alone.

Care begins only after:

Payment is processed in full, and
You complete all required intake forms, consents, and acknowledgments through our OptiMantra Electronic Medical Record (EMR) portal

By enrolling, you authorize Balanced Kids to communicate with you via phone, email, text, and secure EMR messaging for scheduling, care coordination, and clinical communication.

5. Appointments, Scheduling & Virtual Care

Appointments must be scheduled in advance.
Balanced Kids will make reasonable efforts to provide same-day care when clinically appropriate and available.
If in-home care is unavailable, virtual care may be offered to ensure continuity.
Availability may vary based on demand, provider availability, geography, weather, and clinical urgency.

6. Membership Terms & Billing

Commitment Period

Sick Kids and Balanced Kids Memberships require a 12-month initial commitment, unless otherwise stated at purchase.
After the initial term, memberships convert to month-to-month.
Month-to-month memberships do not require a long-term commitment.

Cancellation Notice

A minimum of 30 days’ written notice is required to cancel a membership.
Notices must be submitted via the email on file or another method designated by Balanced Kids.

Prepaid Packages

Prepaid packages (e.g., 6- or 12-month packages) are non-refundable once purchased.

7. Payment Terms & Refund Policy

By purchasing services, you agree that:

Membership and package fees are non-refundable, except in extraordinary circumstances at Balanced Kids’ sole discretion.
No refunds or credits are provided for unused services.
Payment is due at the time of service unless otherwise agreed upon.
Payments are processed via Stripe or other approved payment platforms.

8. Travel Fees

In-home visits involve dedicated travel time and resources. Travel fees help offset:

Reserved provider travel time
Fuel, vehicle maintenance, and wear
Reliable in-home scheduling

All travel fees are disclosed in advance within pricing materials and the Balanced Kids Information Packet.

9. Cancellation & Missed Visit Fees

Because availability is intentionally limited:

À La Carte Clients

Virtual visit canceled <24 hours: $25 fee
In-home visit canceled <24 hours: 50% of visit cost (excluding travel)

Members

Virtual visits: No cancellation fee
In-home visits canceled <24 hours: $50 fee

10. Medical & Educational Disclaimer

Balanced Kids provides clinical pediatric care within our licensed scope.
However:

Integrative health education and plant medicine consultations are educational only and not a substitute for diagnosis or emergency care.
Always seek emergency services when indicated.

11. Insurance & Billing

Membership fees are not billable to insurance and are not reimbursable.
Some clinical services may be eligible for insurance reimbursement depending on payer policies.
Membership is not a substitute for health insurance.

12. Privacy & HIPAA

Balanced Kids complies with HIPAA and applicable privacy laws.
Your information is collected, used, and protected as outlined in our Privacy Policy.

13. Website Use & Intellectual Property

You agree not to:

Use the website for unlawful purposes
Attempt unauthorized access
Copy or distribute content without written permission

All website content is the intellectual property of Balanced Kids Health, LLC.

14. Safety, Termination & Provider Rights

Balanced Kids reserves the right to terminate services immediately, without refund, for:

Threats to provider safety
Unsafe environments
Harassment, abuse, or disruptive behavior
Any reason deemed appropriate by the practice

By enrolling, you agree not to pursue legal action related to termination under these conditions.

15. Limitation of Liability

To the maximum extent permitted by law:

Balanced Kids is not liable for indirect, incidental, or consequential damages.
Services are provided “as-is” without guaranteed outcomes.
You agree to hold Balanced Kids harmless for care-related dissatisfaction or outcomes.

16. Amendments

Balanced Kids may revise these Terms at any time. Continued use of services constitutes acceptance of updated terms.

17. Governing Law

This Agreement is governed by the laws of the State of Minnesota.

18. Acknowledgment & Acceptance

By purchasing services and completing intake documentation, you acknowledge that you:

Have read and understand this Agreement
Agree to be legally bound by its terms
Have had the opportunity to ask questions prior to enrollment
